         FMM Malacca Advisory on “Cuti Peristiwa” on August 26, 2024

1. The Malacca State Government has declared August 26, 2024 as “cuti peristiwa", as an additional Public Holiday for the year 2024in accordance with Section 9 of the Holidays Act, 1951 in conjunction with the celebration of the 75th birthday of His Excellency the Governor of Melaka.
2. Public Holiday on the August 24, 2024, is a compulsory Public Holiday which cannot be substituted by virtue of Section 60D(1)(a)(iii) of the Employment Act 1955. All companies are required to observe this holiday.

3.   In conjunction with the holiday declaration on August 26, which is not a compulsory holiday, but if members have declared in the Contract of Service, Handbook or Collective Agreement that their company will observe all gazetted public holidays both State and Federal holidays then they have the following options:

i)              Observe the public holiday and allow employees the day off with pay; OR

ii)      Request employees to work on the holiday declared and compensate them by paying additional two days wages at the ordinary rate of pay; OR  

iii)     Request employees to work on the holiday and inform that the holiday will be substituted on another day. Kindly take note of the following:

a)   Wages for work on that day is the normal rate, not public holiday rate;

b)   The company can substitute the holiday;

c)   The company has to fix the replacement date which need not be the same date for all employees.
